familyken.com Terms Of Service
By signing up and actively using the familyken.com program the member agrees
to all terms and conditions set forth in this agreement. familyken.com may,
at any time, choose to edit, add and/or delete portions of this agreement
and impose changes without prior notification of its members. Members
will be informed of any and all changes to this policy via an administrative
message available in the member's area and upon first login after the
message has been created. If any modification is unacceptable to the member,
the members's only recourse is to terminate this agreement by unsubscribing
from the program. Those members who continue to participate in the familyken.com
program following our posting of a change in policy notice or new agreement
on our site will constitute binding acceptance to the change.
Responsibility of Members:
Our program is open to members from a large number of countries and is
void where prohibited by local governing laws.
We don't accept any sign up and using of the site via open/anonymous proxy servers.
The member must be 14 years of age or older to participate in this program
and must be able to understand, read, and write English language.
The member agrees to and must use his/her own real name, email address
and real street/postal address including correct residential country in
the sign-up process and may not assume a false identity. The user may
not sign-up multiple times with different email addresses.
The member's computer and IP must not be shared with another individual
that has an existing familyken.com account.
Every member has to choose keywords in his/her account info section.
There are bad ones to verify that the member understands English
language. The member should not check those bad keywords or his/her account
will be deleted. Also if a member checks both keywords specifying
the gender or more than one age group he/she is treated as not understanding
English. The member should not check the "I own/run a PTR site"
keyword unless he/she is in fact a collegue. In that case, he/she should
send in a support ticket and tell us, what site(s) he/she owns. Every
member has to show her/his acceptance of these terms by checking the box
"I agree to Rules of familyken".
If the member clicks three or more cheat links (email and/or banner),
his/her account will be canceled and he/she will forfeit all earnings
and referrals. The cheat links at familyken.com are all clearly marked.
If the member clicks more than 30 bad turing numbers in one month, his/her
account will be terminated too.
Cheating of any kind will not be tolerated. That includes, but
is not limited to, using open/anonymous proxy services to hide your own IP, using any
kind of cheating software like mass sign-up or link grabbing software.
All paidlinks have to be clicked through your email account or pages of
the familyken website. The account of a proved cheater will be canceled
and he/she will forfeit all earnings and referrals.
If a user clicks search ads or targeted tier 1&2 or tier 1
ads from a disallowed country, his/her account will be canceled. As we
have taken measures that only the members from appropriate countries are
able to click these ads, clicking from disallowed countries means active
cheating.
In case a free member is promoting the PTP link reserved only for upgraded
members, this is considered cheating and will lead to termination of account.
Upgraded members are allowed to promote free and upgraded link.
We will post all usernames of accounts, that are deleted because of cheating
at our public list of canceled accounts at familyken.com. We will not post
usernames, who have been deleted because of inactivity.
Our activity requirements are the following:
Account will be suspended, if a member has not clicked at least one
link in the last 30 days. After suspension the member has 30 days
to request restoration of this account. After a total of 60 days of inactivity
the account will be deleted from the database.
Members may set their account on vacation for a maximum of 50 days.
Account will be deleted, if it is not activated within 10 days after end
of vacation date. Activating an account after a vacation and then setting
on vacation again is not considered being active and will lead to deletion
of account. In case of an emergency or circumstances which cause you to
take a longer inactive period, you may contact familyken.com and request
permission to stay as a member while inactive for a longer while.
If a member wishes to promote an Affiliate Page and/or PTP links from
familyken.com, the member has to click a minimum of 50 links (Email and/or
PTC) monthly. In case the member does not fullfill this minimum, Affiliate
Page and/or PTP promotion will be suspended till the member complies with
the requirement again.
Member has to submit a minimum of 40% valid traffic and no more than
10% of proxy traffic to the PTP pages, he/she is promoting. Members are
able to check their results within the member area. Not fullfilling these
requirements leads to suspension from PTP promotion after 30 days.
Member has to promote the Affiliate page and/or PTP page at other websites
within the upper part of this website, so that any visitor of this
website is able to see the main part of our Affiliate Page and/or PTP
page without scrolling down or aside. In case the member promotes Affiliate
page and/or PTP page in not immediate visible part of a website, this
is considered cheating and will lead to termination of account.
Every member will use his/her email address / password combination to
access his/her account, it is the member's responsibility to keep this
information confidential. The member may change this information by logging
into his/her account and following the "Account Info" link.
The member is solely responsible for any and all use of his/her familyken.com
account including authorization by him/her to any third party individual
who may use his/her account.
Should any instances of fraud, system abuse, or any type of activity deemed
to be inappropriate or illegal by familyken.com be detected, it may result
in member termination and possible legal action.
Any solicitation of advertisers for a confirmation email for purposes
of receiving credit in your account will be grounds for immediate termination.
The user must maintain his/her email account that he/she has listed in
the userinfo with familyken.com. The member agrees to receive e-mail advertising
from familyken.com.
In the event his/her e-mail account on file becomes closed or blocked
to messages from familyken.com, the account will be terminated. This especially
applies to e-mail accounts returned for being Full. Any member sending
us gibberish will result in automatic termination of account and forfeiture
of all earnings to date of termination. Members using auto-responders
will also be deleted immediately. It is the member's responsibility to
ensure that mail from familyken.com is whitelisted.
The member may not promote his/her referral links through unsolicited
emailing (i.e. Spamming), newsgroup postings, or any other method
of mass communication. Failure to comply will lead to immediate termination
of membership with familyken.com and may result in legal prosecution.
familyken.com does not allow members to sell accounts or advertising without
our permission. This rule is valid for ads from redemption page too.
Relationship of the Parties:
You and familyken.com are independent contractors, and nothing in this agreement
creates any partnership, joint venture, agency, franchise, sales representative
or employment relationship between you and familyken.com. You understand
that you do not have authority to make or accept any offers or make any
representations on behalf of familyken.com. You may not make any statement,
whether on your site or otherwise, that would contradict anything in this
section. You are solely responsible for the reporting and payment of any
taxes for money earned while using the program.
Limitation of Liability:
familyken.com will not be liable for lost profits, lost business opportunities,
or any other indirect, special, punitive, incidental or consequential
damages arising out of or related to this agreement or familyken.com program,
even if familyken.com has been advised of the possibility of such damages.
Furthermore, familyken.com aggregate liability arising under this agreement
will not exceed the amount of the total fees paid or payable to you under
this agreement. The provisions of this section survive termination or
expiration of the agreement.
Payments:
Members may earn by receiving paid-emails and visiting the advertisers
websites after they have entered their member ID in the area on the website
provided by familyken.com.
Members may earn by referring new members and advertisers to the familyken.com
program.
Referral commission is 12% one level deep for both cash and points
with no actvity requirements additional to the regular ones at familyken.com.
Members will be paid via AlertPay, LibertyReserve or Paypal.
Members may request a payout by clicking the payout button. There is no-mimum
requirement for Paypal, $1 minimum for Alertpay and
LibertyReserve.
Currently we do not charge any fees for any sort of payout. Paypal
payouts are processed via "masspay", so no fees would occur
for the members by Paypal. Please be adviced, that the other payment processors
will retain fees for any payout to your account, that are beyound our
control.
New members may ask for payout not earlier than 2 weeks after joining
familyken.com.
All payout requests will be gathered throughout the week and are processed
at weekend. So maximum waiting time should be 8 days, if you request
at Saturday just after we have processed payouts and coincidentally we
pay next weekend not before Sunday. Of course in most cases you will have
to wait much shorter time, if you send in your request just before weekend
(Sat/Sun).
familyken.com Rights:
The member agrees that familyken.com has unlimited rights concerning the
program.
familyken.com reserves the right to change anything, at anytime, with notification
through administrative message to the members notifying them of the change
or changes.
The value of Paid-to-Promote credits and cash earnings and the weight
of tiers may be adjusted when necessary, depending on advertsing results
and revenue. The cash value of hits to Affiliate Pages may be adjusted
too when necessary. There will be no refunds for of paid advertisings,
Upgrades or Affiliate Pages in any case.
familyken.com's Privacy Statement:
familyken.com uses your IP address to to gather demographic informations,
diagnose cheating and unusual traffic to our server, and to target special
ads to appropriate members. familyken.com may use cookies to save your password,
so you don't have to reenter it each time you visit our site, to deliver
content targeted to your interests, and for other purposes. familyken.com
registration form requires to give us contact informations (name, address,
and email address). familyken.com uses these contact information to send
information about familyken.com and email advertisements to the member and
to process payments of earnings from our program.
Members may at any time opt-out of receiving future mailings. Therefore
the member has to log in to the account and click the "User Account
Info" link. At the bottom of the page the member will find the option
to "Cancel Account".
This site contains links to other sites. familyken.com is not responsible
for the privacy practices or the content of these linked websites.
Advertising at familyken.com:
familyken.com does not accept advertising for adult sites of any kind or
sites with illegal content, that includes, but is not limited to, sites
with violations of intellectual property rights, violence, illegal activities,
or discrimination based on race, sex, religion, nationality, disability,
sexual orientation or age.
familyken.com reserves the right to refuse advertising for all programs
that run invisible 0-iframes to cheat other programs or generate false
traffic or that contain more than three popups.
familyken.com reserves the right to refuse advertising for programs listed
on the GPTBoycott BoycottList
and the Cash
Crusader Unlicensed List.
familyken.com refuses advertising for all sites, which are on our list of
Banned Sites.
Advertising for websites in another language than English may be sent
targeted to relevant language zones only.
If a member redeems for an ad that is rejected, the amount (points or cash)
will be returned to the members's account and the member will receive a notice that the
ad was rejected because of not following the rules.
If an upgraded member sends in an ad which comes with the upgrade and which is rejected, there is no way to refund this ad, but the member will receive a notice that the ad was rejected because not following the rules and may send in a replacement ad via helpdesk ticket.
Advertisers changing their advertising after it has been checked and sent
to members will have this advertising canceled.
